TERMS AND CONDITIONS OF SERVICE

IMMACULATE DETAILING INC.

This Service Agreement ("Agreement") is entered into between the customer ("Client," "you," or "your") and Immaculate Detailing Inc., a incorporated company organized under the laws of New York ("Company," "we," "us," or "our"). By engaging our services, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions.

SERVICE DESCRIPTION AND LIMITATIONS

Interior Cleaning Services
Our interior cleaning services include vacuuming, surface cleaning, and conditioning of interior surfaces. However, certain limitations apply:

  1. Pre-existing stains, discoloration, or damage may not be completely removable despite our best efforts34

  2. Stains caused by bodily fluids, food, beverages, ink, dye, or other substances may be permanent and cannot be guaranteed for complete removal

  3. Excessive pet hair, sand, or debris may require additional time and incur supplemental charges

  4. Leather conditioning results may vary based on the age, condition, and type of leather

Exterior Cleaning and Paint Services
Our exterior services are subject to the following limitations:

  1. Excessive tar, tree sap, brake dust, or industrial fallout removal constitutes additional services and will incur extra charges beyond the base service price

  2. Road paint removal is a specialized service requiring additional time, materials, and expertise, and will be charged separately

  3. Paint correction services are limited by the existing paint thickness and condition of your vehicle's clear coat


  4. Touch-up paint services are cosmetic improvements and may not perfectly match factory paint due to age, fading, or color variations



Ceramic Coating and Paint Protection Film

  1. Ceramic coating performance and longevity depend on proper maintenance and environmental factors beyond our control

  2. Paint protection film installation requires adequate paint condition and may not adhere properly to previously damaged or compromised surfaces

  3. Warranty coverage for these services is governed by manufacturer specifications and separate warranty documents

  4. Paint protection film is subject to a finite amount of contamination as it is unrealistic to have a perfect environment on installation

  5. White paint is subject to edges picking up dirt in the film adhesive, and will become visible over time

Vinyl Wrap and Window Tinting

  1. Vinyl wrap adhesion and longevity depend on surface preparation and the existing paint condition

  2. Window tinting is subject to local and state regulations, which you are responsible for understanding and complying with

  3. Removal of existing vinyl, PPF and or graphics may reveal underlying damage or discoloration

Odor Removal Services

  1. Complete odor elimination cannot be guaranteed, particularly for smoke, pet, or biological odors that have penetrated porous materials

  2. Multiple treatments may be necessary for severe odor issues, resulting in additional charges

VEHICLE CONDITION AND PRE-EXISTING DAMAGE

You acknowledge and agree that:

  1. You are responsible for pointing out any pre-existing damage, scratches, dents, or mechanical issues before service begins

  2. We shall not be held liable for any pre-existing conditions, mechanical problems, or damage that existed before our services

  3. Any damage claims must be reported within 48 hours of service completion

  4. Damage claims require at least two independent diagnostic reports or repair estimates proving our services caused the damage



PERSONAL PROPERTY AND BELONGINGS

  1. You must remove all personal belongings, valuables, money, and fragile items from your vehicle before service begins

  2. We are not responsible for any loss, theft, or damage to personal property left in your vehicle

  3. Items deemed fragile or non-functional must be identified before service commencement

  4. We reserve the right to refuse service if excessive personal property remains in the vehicle

PRICING AND PAYMENT TERMS

Service Estimates and Final Pricing

  1. All estimates are preliminary and subject to change based on actual vehicle condition and required services

  2. Final pricing is determined after an on-site inspection and confirmation of services needed

  3. Additional charges apply for services beyond the scope of the original estimate, including but not limited to:

    1. Excessive contamination removal (tar, sap, brake dust)

    2. Road paint removal

    3. Extra time is required for heavily soiled vehicles

    4. Specialized stain removal attempts

    5. Additional paint correction steps

  4. We are responsible for notifying you of any price changes necessary while working on the vehicle.

Payment and Deposits

  1. A non-refundable deposit of 10% is required at the time of scheduling for all services

  2. The remaining balance is due upon completion of services

  3. We accept cash, checks, and major credit cards

  4. Returned checks will incur a $35 processing fee




CANCELLATION AND SCHEDULING POLICY

  1. Cancellations require 48 hours' advance notice to avoid forfeiture of deposit

  2. Two instances of no-show or last-minute cancellation will result in the termination of the service relationship

  3. Rescheduling is subject to availability and must be completed within 30 days of the original appointment

LIMITATION OF LIABILITY

Damage Limitations
Our total liability for any claim arising from our services is strictly limited to the amount paid for the specific service in question. We shall not be liable for:

  1. Consequential, indirect, incidental, or punitive damages

  2. Lost profits or business interruption

  3. Damages exceeding the service fee paid

  4. Pre-existing conditions or mechanical failures

  5. Damage caused by acts of nature, theft, vandalism, or circumstances beyond our control

Service Limitations

  1. Paint correction results depend on existing paint thickness and cannot be guaranteed to achieve perfection

  2. Stain removal success varies by stain type, age, and material affected

  3. Odor removal may require multiple treatments and cannot be guaranteed for complete elimination

  4. Ceramic coating and paint protection film performance depend on proper maintenance and environmental factors


WARRANTIES AND GUARANTEES

Service Guarantee
We stand behind our workmanship indefinitely and are committed to ensuring your complete satisfaction with our services. However, the following conditions apply:

  1. Complaints must be reported within 48 hours of service completion

  2. Re-service must be scheduled within 7 days of original service date

  3. Outstanding balances must be paid before guarantee service can be provided

Coating and Paint Protection Film Assessment
For ceramic coating and paint protection film services, if you believe there has been a failure or defect in the product or application:

  1. A cleaning fee will be assessed to properly evaluate the coating or film condition

  2. This cleaning fee is required to remove environmental contaminants, dirt, and debris that may mask or mimic coating/film failure

  3. Only after proper cleaning and assessment can we determine if warranty coverage applies

  4. If our assessment confirms a legitimate product or application failure covered under warranty, the cleaning fee will be credited toward the warranty repair or replacement

Warranty Exclusions
Our guarantee does not cover:

  1. Damage caused by customer negligence or misuse

  2. Normal wear and tear following service

  3. Damage from environmental factors (bird droppings, tree sap, road salt, etc.)

  4. Issues arising from failure to follow maintenance recommendations

  5. Coating or film degradation due to improper maintenance or care

  6. Damage from automatic car washes, harsh chemicals, or abrasive cleaning methods






RISK ACKNOWLEDGMENT

You acknowledge that:

  1. Vehicle detailing involves inherent risks that cannot be eliminated

  2. Your vehicle will be cleaned at your own risk, and must be able to withstand normal cleaning processes

  3. Some cleaning processes may reveal pre-existing damage or wear not previously visible

  4. Results may vary based on vehicle age, condition, and maintenance history

INDEMNIFICATION

You agree to indemnify and hold harmless Immaculate Detailing LLC, its members, managers, employees, and agents from any claims, damages, losses, or expenses arising from:

  1. Your failure to disclose pre-existing damage or conditions

  2. Personal property left in your vehicle

  3. Your violation of these terms and conditions

  4. Any misrepresentation of your vehicle's condition or history


DISPUTE RESOLUTION

Any disputes arising from this Agreement shall be resolved through binding arbitration in Erie County, New York, under the rules of the American Arbitration Association. The prevailing party shall be entitled to reasonable attorney's fees and costs.

GOVERNING LAW

This Agreement shall be governed by the laws of the State of New York without regard to conflict of law principles.

SEVERABILITY

If any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.

ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between the parties and supersedes all prior negotiations, representations, or agreements relating to the subject matter herein.
